Terms & Conditions

When a customer purchases a product from The Garden Workspace Company Limited, the customer is agreeing to the terms and conditions as set out below.  Customers are advised to read the following terms and conditions carefully.

A project specific manager is assigned to each project, they are available to answer any questions you may have.

Telephone calls to and from our office may be recorded. 

Payment details will not be taken over the telephone, payments for deposits will be made via a third party (Paypal etc) or by bank transfer. 

The Company will not ask for, nor will it record in anyway, any bank or other financial institutions information. 

All payments must be immediate cleared funds, we no longer accept cheques or bankers’ drafts.

Placing your order

Once an order is placed, we will send a confirmation of order detailing your specification. We would strongly advise you to check that the details including cost, measurements and specifications are correct.  These are usually sent via email; a hard copy can be posted if requested.

All buildings are made to order and are specific to each project, we will provide a floor plan and elevations showing walls and ceilings following our site visit. This will be in addition to a schedule showing all of the choices you have made for materials, finishes and locations.  Once these options have been confirmed/agreed, they will be placed on order with our suppliers and any changes may result in a charge to you. 

By paying a deposit and so placing the order with The Garden Workspace Company, you are agreeing to purchase all of the items that are detailed in the signed order form.

The delivery date will be confirmed at point of order.  We will endeavour to deliver to you on the given date. If, for some reason we cannot make this date due to circumstances beyond our control (for example, breakdowns, strikes, material shortages, sickness etc), you will be informed as soon as possible, and a new delivery date agreed. There will be no compensation should we be unable to attend progress as originally agreed.

All our pricing and charges do not include VAT which is shown as a separate item.

Payments and deposits

It is important to note that when an order is placed, a contract is formed.

The customer is agreeing to bear the full cost of any bespoke and/or non re-stockable materials which have been ordered.  We will endeavour wherever possible to re-stock materials. Any charges will be passed on.

Stage 1

We require a non-refundable deposit of £500 to generate designs and drawings for your approval, and to set a start date. This £500 is deducted from the final payment should you choose to proceed with the build.

Stage 2

Once the drawings are agreed/signed-off we require 30% of the total to allow longer lead items such as windows and doors (specialist timbers etc) to be ordered. We will contact you to confirm when the delivery of the bulk of the materials will take place.

Stage 3

We require 30% of the total on the day that we start on site - our team will not commence works until this payment is received.

 

Stage 4

At the point where the structure is watertight, a further 30% of the original balance is to be transferred.  Watertight is defined as roof installed and covering applied, cladding, doors and windows installed.

Final stage

The project is completed and inspected by the customer.  We will provide all manuals and paperwork that relate to your new structure, including the care and maintenance instructions.  At this stage, a transfer for the remaining 10% balance will be due, minus the original £500 deposit. Any additional costs which have been agreed during the project, will also be due at this stage.

We do not accept the holding of any retainers or similar for any reason including snag items. The build will be snagged and signed off by the client prior to the request for final payment.

 

Cancellation period

It is imperative that you are fully aware of your obligations in relation to the cancellation of an order as laid out above. For this reason, we will send you the quote.  By making the payment and signing the order forms the offer from The Garden Workspace Company Ltd has been accepted.

Customer Finance Agreements

The Garden Workspace Company is an approved partner of Kandoo, a Trading Style of Switcha Limited which is authorised and regulated by the Financial Conduct Authority, Firm Registration Number: 828963 for Credit Broking and Insurance Distribution.

The Garden Workspace Company is an Introducer Appointed Representative (‘IAR’) of Switcha Limited.

 

The Garden Workspace Company is not liable for any financial service obtained through the credit lender.
 

Credit is available to UK residents only and is subject to application, status and lending criteria.
 

Important Information regarding Customer Provided Base 

We strongly suggest that you employ our team to construct the base as a part of your order however in certain circumstances it may be agreed that the customer will provide the base.  Where the customer provides the base this will not form any part of the warranty and may cause some limitations on the warranty we are able to provide for the structure.  This will be confirmed at point of order.

Erection of your building can only take place if the base provided by yourself is absolutely level and has been completed as per the design and sizes provided to you.  The base should be exactly as we, GWS have requested. Failure to provide a compliant base may result in an aborted visit and/or charges. Any base must also be sufficiently cured for our team to start work. If you are laying a concrete base, then we would suggest that it is given at least 7 days to harden before any work starts.  If you have any queries with regards to your base, please contact the office at the earliest convenience.

Access

Access to the site will be provided by the customer.  We will discuss and agree these requirements during our initial site visit.

We take no responsibility for any onsite conditions or situations that are beyond our control or that we have not been made aware of.  If our installation cannot proceed for reasons that we have not previously been made aware of we will agree on how to resolve the situation, however this may incur additional fees as this will be deemed to be outside of our agreement.

Planning Permission

We are not obliged to check any planning permission within your area.  The onus is on the customer to have this confirmed prior to any ordering process.  The company accepts no liability whatsoever in respect of breaches of planning or similar regulations or laws where we have not been contracted to undertake this work.

We will however, based on our past experience, advise if a particular design and/or feature would normally require planning permission.

Delivery and Installation

We will agree a commencement date for work and deliveries to begin.

We ask for as much notice as possible when requesting a change of date. We will try to accommodate where possible.

The customer will be expected to provide mains electricity and water.

We also require clear access to the site and surrounding area (confined to the area surrounding the build site). 

We will make all possible efforts to be as unobtrusive as possible. However, it is suggested that neighbours are informed that works will be taking place, as some of the equipment used will generate noise.

We will clear all rubbish generated by the build; this will be disposed of by a licenced carrier/ transfer station.  Evidence will be made available on reasonable request and this will be retained by the Company so remains available.

The main structure will be made of natural materials and so minor deviations, blemishes and other characteristics of the materials may become apparent.  We will only use the quality materials as have been agreed and you will be shown samples of this.  We accept no responsibility for naturally occurring irregularities or defects in materials that were not immediately apparent during the construction period.  If there is any doubt, the installation team will endeavour to make you aware of any obvious irregularities prior to their use (unusual knots or patterns would be an example of this.) 

The structure will be constructed to the highest standard, however, as with all bespoke construction this is completed to a tolerance.  We define this as being +/- 3% to a minimum of 5mm in any plane, length or other medium of measurement.

Completion of order

When the building is approaching completion, we will agree a date for final inspection by the client or clients representative. Any issues must be pointed out at this stage and a new date will be set for the final sign-off by the client or clients representative. If no points are raised then we will assume that the job is complete, and deemed to have been finished to a satisfactory standard.

Faults or defects

We always strive to build good a relationship with our customers, and we encourage discussions with the installation team. In the event that there is a question or a concern, we ask only that you contact us. We will take whatever steps are deemed necessary to resolve or reassure.

In addition to the above, the warranties which have been provided are backed by the producers of the materials and insurance companies.

Our products and materials

We would like to make it clear that our buildings are sold as garden workspaces as defined by Section 2 of the Building Regulations where permissions/regulations are not required.

Please note that timber, being a natural product, may have inherent defects such as knots, splits, and resin pockets.  As the seasons change, movement can take place - it is not considered to be a defect.

Our timber materials are pressure treated tanalised.  The preservatives protect the wood from attack by termites, other insects, fungal decay and rot for a minimum of 10 years.   Joinery (wooden) windows and doors are not pressure treated and so will be painted in the colour or treated as agreed in the specification page of the order.

We would like to remind customers that timber is an organic product, subject to naturally occurring changes that result from different environmental conditions i.e. changes in colour, surface, splits and shrinkage.  The development and appearance of these natural properties of timber are not defects with the product.

Any timber sizes that we show are approximations and are in metric units. The characteristics of the timber will change over time due to environment conditions.

All buildings should be ventilated to prevent any condensation or mould accumulating inside the building. If mould does appear on the building, we will not be held liable.

All of our images and photography used are purely for illustrations purposes only.  Please be aware that all pictures, product and colours may vary due to the digital photography procedure. However, this will not in any way undermine the overall quality or performance of our product.

Specifications are subject to alterations or withdrawal at any time without notice.  As our policy is to constantly improve design, quality and service we reserve the right to amend, alter or change at our discretion.

Changes to Terms & Conditions

We’re always looking for ways to improve and develop our policies and conduct. Because of this, we reserve the right to alter our terms and conditions whenever necessary without notice, but the terms which you have accepted cannot be changed once you have accepted them. This does not affect your statutory rights.

Additional costs

If we are unable to deliver or erect any of our buildings, through no fault of our own, there will be a charge which must be paid before work commences.

Complaints

Whilst we will make every conceivable effort to ensure you are fully satisfied with your experience and end product, we understand that sometimes issues may arise. 

We take our obligations to our customers seriously and so will deal with any issues raised without delay.
